Purpose of Position

Primary duties to represent a unionized workforce in front of Public Service Staffing Tribunals duties also may include representation at staff relations grievance hearings and National Joint Council grievance hearings.

Qualifications

Education

  • Candidates at a minimum must possess a law degree – LLB designate from a recognized university; or having been called to the bar and be a member in good standing of a provincial or territorial law society would be a definite asset.

Experience

  • The position requires knowledge of, and experience within a unionized environment. More specifically, the position requires a well-developed understanding of the Public Service Staffing Tribunal formal process, including structure of a hearing, standard of proof, knowledgeable of rules of evidence, examination, cross examination, examination in chief, reply and final arguments.

Other qualifications

  • Expert knowledge of labour relations normally acquired through formal legal training. This includes the ability to analyze and interpret federal and provincial labour legislation, various provincial and federal board decisions, case law, and arbitral jurisprudence. Additionally, the position requires superior knowledge of legal research methodology and mechanisms for alternate dispute resolution.
  • Excellent knowledge of principles for federal public service staffing on the abuse of authority as they relate to, language, choice of process, and discrimination as described in the Canadian Human Rights Act.
  • Excellent analytical skills and the ability to synthesize and interpret complex legal issues in order to ensure compliance between legal imperatives, collective agreements and federal or provincial internal policies and procedures.
  • Excellent oral and written communication skills in both English and French and the ability to represent a unionized membership before a third party in either official language.
  • Extensive knowledge of all human resources technical functions in the federal government staffing process.
  • The position requires excellent judgment skills, in order to demonstrate persuasiveness while relying on conflict resolutions methods.
  • The position requires extensive and frequent travel within Canada.
