BYLAWS COMMITTEE REPORT

RECOMMENDED BYLAW CHANGES

It should be noted that the following recommendations from the UNDE Standing Bylaws Committee consisting of Chair Sister Debbie Graham, VP NL/NB, Sister Debra Nadeau, VP ON and Brother Bob Champoux, VP NCR are covered under Recorded Votes (RV) 22 - 27 inclusive of the National Executive meeting of December 02 - 06, 2007 and are presented in that order.

Bylaw 3 Article 1

Add - (b) All members of UNDE shall be considered members in good standing subject to PSAC Constitution Section 4 Sub-Section (2). (NEW)

Bylaw 4 Membership Rights and Responsibility

Add -

Article 1. Every member in good standing as defined in Bylaw 3 Article 1 (b) shall be entitled to the membership rights outlined in PSAC Constitution Section 5. (NEW)

Bylaw 6 Article 1 (d)

Amend to read - A Human Rights Advisor, elected by the Triennial National Convention from among voting delegates within the Human Rights groups as defined in PSAC Constitution Section 15 sub-section (2)(c), shall be an ex-officio member of the National Executive with voice, but no vote.

Bylaw 6 Article 8

Amend to include - The National Executive shall be considered as being in session throughout the period of the UNDE Triennial National Convention, the PSAC National Triennial Convention and the Local President's Conference.

Bylaw 7 Article 7

Add -

Article 7 Each Local shall ensure the UNDE Harassment Statement (Annex A, UNDE Harassment Policy) is read and that at least one Intervener is identified at all UNDE meetings, social and functions. Minutes of all meetings shall identify who read the statement and the identity of the Intervener(s). (NEW)

Bylaw 8 Article 3 Amend to read -

(a) text remains the same
(b) represent the Union as the Senior Executive Officer for their Region (previously (d))
(d) have the authority to attend Local membership meetings and to examine the records and accounts of any Local within their respective Region (previously (f))
(f) be responsible for all joint programs (LMRC, EAP, Health & Safety) (previously h).

(h) be responsible for the organization of Regional Conferences within their regions (previously (e))
(i) be responsible for reviewing resolutions and minutes of adoption meeting for conventions and bargaining demands (NEW)

Bylaw 8 Article 3

Add -

(c) when in attendance of any Local membership meetings within their respective Region, the National Officer shall serve in that capacity but shall not participate in any decisions regarding the affairs of the Locals (NEW)

(a) serve as the Union's representative on the PSAC Equal Opportunities Committee and submit reports to the National Executive (DELETE REMAINING TEXT)
(b) liaise with the employer at various levels on Human Rights issues respecting the established communication with National Executive (NEW)
(c) be responsible for providing presentations on Human Rights issues at Regional Conferences when requested by the respective VP of the Region (NEW)

Bylaw 10 Article 2

Add - All nominees must be duly moved and seconded by members in attendance of the meeting of election of officers. (NEW)

Bylaw 10 Article 5

Amend to read:

(a)The Nominations Committee shall be appointed by the Local President and the Chairperson of such Committee shall be responsible for the preparation of the meeting including ballots and stationery needs and to appoint such assistance as necessary to ensure an orderly election.
(b) The Nominations Committee shall also be responsible for receiving written nominations and for ensuring that in the event the nominee is unable to attend that a signed statement as to their reason for not being in attendance.
(c) The Nominations Committee shall also be responsible to assist the VP of the Region during the election process by collecting and counting ballots. (NEW)

* Changes agreed to in open session to delete requirement for Nominations Committee to arrange facilities in (a) and to change wording in (c) to read "shall also be" in place of "is also"

Bylaw 10 Article 5

Add

(d) In the event the VP of the Region is unable to attend, the Chair of the Nominations Committee would be responsible for conducting the elections. (NEW)

Bylaw 11 Article 2

Amend to read:

The Triennial National Convention of the Union shall be composed of accredited delegates from Locals, the Human Rights Advisor and the National Executive officers of the Union.

Bylaw 11 Article 13

Amend to read:

Locals shall be entitled to present resolutions for consideration by the Triennial National Convention. Such resolutions must have been adopted by the membership and must be received through the VP in National Office of the Union (remaining text stays the same)

Bylaw 11 Article 15 (c)(i) and (ii)

Amend to read:

(i)All voting delegates shall be reimbursed one day's wages/salary plus all entitled benefits for each day they are in attendance at a Triennial National Convention. This would not normally include weekends. If committee members are required to work on weekends, they shall be paid the daily wage rate.
(ii) delegates who are shift workers or who work a compressed week will be reimbursed as in paragraph i) based on their average weekly hours divided by five (5). If such a delegate loses more than their average weekly wages or salary, they must substantiate same by providing a copy of their shift schedule.

Bylaw 12 Article 11

End first paragraph before last sentence

Amend to new paragraph:

Failure to do so shall result in the National Office withholding the Local's rebate of dues until such statement is received by the National Office nor shall the Local be able to attend UNDE training sessions, conferences or conventions.

Bylaw 15

Add -

Article 3 - These Bylaws shall be produced in both the English and the French languages and be made available in alternate media. Copies of these Bylaws shall be distributed to all Locals in a timely manner. (Previously Bylaw 18 Article 2)

Bylaw 16

Add -

Article 2. Organization of Regional Conferences shall be generated by requests from the Locals within the Region and the Local's shall be required to submit agenda items. (NEW)

Article 3. Organization of Education sessions shall be generated upon request of the Locals who shall provide information regarding content, participant level and approximate costs. (NEW)

Article 4. Upon receipt of requests from Locals, the VP of the Region or their designate shall prepare a detailed business case for National President approval. (NEW)

*Changed Article 3 to pluralize Local and added "or their designate" in `open session to recognize the diversity of delivery with the Regions

Amend - The amounts paid from $200.00 to $250.00 in paragraphs 4 and 5.
